1. Who we are

The service is operated by Francesco Bardozzo (Oberlunar) as a personal research project (the "Service"). The Service is published at oberlunar.com and may be referenced via the "Unconventional Traders" project name. Contact: oberlunar@gmail.com.

2. Acceptance of terms

By creating an account, signing in, or otherwise using the Service, you represent that you are at least 18 years of age, have legal capacity to enter into this agreement, and accept these Terms in their entirety. If you do not accept, do not use the Service.

3. The Service is NOT financial advice

All content provided by the Service — including analytics, charts, dealer positioning estimates, gamma exposure (GEX) computations, risk-neutral densities, walls, ranges, indicators, written commentary, and any output of automated or manual analysis — is provided for educational and research purposes only. It is NOT financial advice, NOT investment advice, NOT a recommendation to buy, sell, or hold any security, derivative, or other instrument, and NOT a solicitation of any kind.

The Service is not a registered investment advisor (RIA) in the United States, is not authorised under MiFID II in the European Union, and is not a financial intermediary under Italian law (D.Lgs. 58/1998, TUF). The operator does not hold any equivalent authorisation in any other jurisdiction.

You alone are responsible for your investment decisions and trading activity. You should consult independent, licensed financial, legal, tax, or other professional advisors before making any decision based even indirectly on content seen here.

4. No accuracy guarantee

The Service ingests data from third-party market data providers (CBOE, TradingView consensus feeds via brokers BLACKBULL/ICMARKETS/OANDA, and others). The operator does not control these sources, cannot guarantee their accuracy, completeness, timeliness, or availability, and is not responsible for any errors or omissions in the underlying data.

Analytics computations (GEX, Breeden-Litzenberger RND, walls, ranges, manipulation filters A1/A2/A3, etc.) are built on assumptions that may not hold in all market conditions. Results may be stale, partial, or structurally biased in ways not visible to the user.

5. No guarantee of uptime, persistence, or correctness

The Service is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability.

Specifically, you acknowledge that:

The Service may be unavailable for maintenance, hosting outages, or any other reason, with or without notice.
Historical data, member accounts, profiles, bios, avatars, and any other content may be lost, corrupted, or deleted at the operator's sole discretion or due to events outside the operator's control.
Analytics outputs may be wrong, late, missing, or otherwise unreliable.
Account features (registration, login, password reset, presence) may be added, modified, or removed at any time.

6. Limitation of liability

To the maximum extent permitted by applicable law, in no event shall the operator, his agents, contractors, or affiliated parties be liable for any direct, indirect, incidental, consequential, special, punitive, or exemplary damages, including but not limited to loss of profits, loss of revenue, loss of capital, loss of opportunity, loss of data, loss of reputation, or any other intangible loss, arising out of or in connection with your use of, or inability to use, the Service, whether based on warranty, contract, tort (including negligence), or any other legal theory, even if the operator has been advised of the possibility of such damages.

Where applicable law does not permit the exclusion of certain warranties or the limitation of liability for certain damages, the operator's liability is limited to the maximum extent permitted by law. REVIEW: in EU consumer contexts (Codice del Consumo Art. 33 ss.), absolute exclusion of liability for gross negligence or willful misconduct is unenforceable. Counsel should advise on the exact wording for the Italian and EU contexts.

7. Your account and conduct

You agree to:

Provide accurate registration information.
Keep your password confidential and not share your account.
Not impersonate other persons or entities.
Not attempt to gain unauthorised access to the Service, its infrastructure, or other users' accounts.
Not use the Service to engage in unlawful activity, harassment, defamation, or to distribute content you do not have the right to distribute.
Not scrape, mirror, reverse-engineer, or otherwise extract analytics outputs in bulk for redistribution or commercial use without prior written consent.

The operator reserves the right to suspend, terminate, or restrict access for any reason, in particular for violation of these Terms, without prior notice.

8. Intellectual property

The platform code, analytics engine, content, designs, and branding (including the names "Oberlunar", "Oberlunar Chain", "Unconventional Traders") are the intellectual property of Francesco Bardozzo. You receive no licence to use, copy, modify, redistribute, or create derivative works, except as strictly necessary to use the Service for its intended purpose.

Content you upload (bio, avatar, public_email) remains yours; by uploading it, you grant the operator a non-exclusive, royalty-free, worldwide licence to display it within the Service for the purpose of operating the community feature.

9. Third-party services

The Service uses third-party providers (hosting, font CDN, market data APIs). These providers operate under their own terms; the operator is not responsible for their conduct, availability, or content.

10. Governing law and venue

These Terms are governed by the laws of Italy, without regard to its conflict-of-laws principles. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent court of the place of residence of the operator, except where mandatory consumer protection rules grant the user a right to a different forum. REVIEW: confirm with counsel that your residence aligns with the preferred jurisdiction; mandatory EU consumer rules may override the venue clause.

11. Severability

If any provision of these Terms is found unenforceable, the remaining provisions shall continue in full force and effect.

12. Changes

The operator may change these Terms at any time. Material changes will be notified via the portal home page and to logged-in users. Continued use after notice constitutes acceptance.

13. United States users — additional notice

If you access the Service from the United States, you also acknowledge:

This Service is not registered with the U.S. Securities and Exchange Commission (SEC), the Commodity Futures Trading Commission (CFTC), the Financial Industry Regulatory Authority (FINRA), or any state securities regulator.
The operator is not an "investment advisor" within the meaning of the Investment Advisers Act of 1940.
Nothing on this Service constitutes the offer or solicitation of any security in any jurisdiction.
You are responsible for compliance with all applicable US federal and state laws regarding the use of this Service.
